Article 1 - Definitions

Customer: The person with whom Floewi has entered into an agreement.

Parties: Floewi and the Customer together.

Consumer: A Customer who is also an individual acting as a private person.

Article 2 - Applicability

These terms and conditions apply to all offers, quotations, orders, agreements, and deliveries of services or products by or on behalf of Floewi.

Deviations from these terms are only valid if agreed upon in writing.

The general terms and conditions of the Customer are explicitly excluded.

Article 3 - Prices

All prices on the Floewi website are displayed in euros (€), including VAT, but excluding any additional costs such as shipping or administrative fees, unless otherwise stated.

Floewi may change prices at any time.

If unforeseen cost increases occur after an order has been placed, Floewi has the right to adjust the price.

In case of a price increase, the Consumer has the right to cancel the agreement unless the increase is legally required.

Article 4 - Samples and Models

If the Customer receives a sample or model, it is for illustrative purposes only and no rights can be derived from it unless explicitly agreed in writing.

Article 5 - Payments & Payment Term

Floewi may request a deposit of up to 50% of the total amount when entering into an agreement.

The Customer must complete the payment within 30 days after delivery.

If the Customer fails to pay on time, they will be in default without the need for a reminder.

Floewi may choose to ship an order only after payment is received or require a form of security.

Article 6 - Right of Reclamation

If the Customer fails to pay, Floewi has the right to reclaim the delivered products.

This will be notified to the Customer in writing or electronically.

The Customer must immediately return the products at their own expense.

Article 7 - Right of Withdrawal

Consumers have a 14-day cooling-off period for online purchases without providing a reason.

Exceptions to the Right of Withdrawal:

The right of withdrawal does not apply to:

✔ Perishable products.

✔ Custom-made or personalized products.

✔ Products that cannot be returned for hygienic reasons (e.g., underwear, swimwear).

✔ Digital data carriers (e.g., CDs, DVDs, USB drives).

✔ Magazines and newspapers.

The 14-day reflection period starts on the day the Consumer receives the order.

The Consumer can initiate a return by sending an email to info@floewi.nl or filling out the withdrawal form on the website.

The product must be returned within 14 days after the withdrawal request.

Article 8 - Reimbursement of Shipping Costs

If a Consumer fully returns an order within the withdrawal period, Floewi will refund the shipping costs within 14 days.

Article 9 - Return Costs

The Customer is responsible for return shipping costs, which depend on the chosen shipping method.

Article 10 - Retention of Ownership

Floewi remains the owner of all delivered products until the Customer has fully paid the invoice.

The Customer may not resell, pledge, or encumber the products before ownership is transferred.

Article 11 - Delivery & Delivery Time

Delivery is subject to stock availability.

Orders are delivered to the address provided by the Customer.

Delivery times are indicative and not a strict guarantee.

In case of delays, the Customer will be notified, and the order may be canceled if delivery cannot be completed within 14 days.

Article 12 - Warranty

The warranty applies only to manufacturing defects and material faults.

The warranty does not apply if:

❌ The damage is caused by incorrect use.

❌ The Customer has modified the product.

Article 13 - Complaints Procedure

Customers must report any complaints as soon as possible via info@floewi.nl.

Complaints will be addressed within 14 days.

Article 14 - Liability

Floewi is only liable for direct damage caused by intent or gross negligence.

Floewi is not liable for:





If liability is established, it is limited to either the invoice amount of the order or the amount covered by Floewi’s insurance.

Article 15 - Force Majeure

Floewi is not liable for failure to fulfill obligations due to force majeure, including but not limited to:

⚡ Power, internet, or server failures.

🚧 Strikes and work stoppages.

🌍 Natural disasters and pandemics.

🏛 Government measures that affect delivery.

In case of force majeure, obligations will be suspended or the agreement may be terminated.

Article 16 - Changes & Termination of Agreement

Floewi reserves the right to modify these general terms and conditions.

Consumers may terminate their agreement if significant changes are made.

Article 17 - Governing Law & Disputes

All agreements with Floewi are governed by Dutch law.

Disputes will be submitted exclusively to the competent court in the jurisdiction where Floewi is established.
